BIPC Fires Back: Files Defence and Counter Claim Against Ex-MD in N104M Legal Battle

A high-stakes legal showdown has erupted between Benue Investment and Property Company Limited (BIPC) and its former Managing Director, Dr. Alex Ter Adum, as the company formally filed its Statement of Defence and Counter Claim in response to Suit No. NICN/MKD/106/2024.

The suit, brought by Dr. Adum against the Benue State Government and the Attorney General and Commissioner for Justice and Public Order, challenges the termination of his appointment.

The matter came up for mention at the National Industrial Court on February 28, 2025. According to court records confirmed by the bailiff and clerks, both parties have been duly served with all legal processes.

Ex-MD Seeks N158M in Compensation

Dr. Adum is contesting his dismissal, claiming that his appointment, which was to run from August 20, 2019, to July 19, 2024, was unlawfully terminated on June 1, 2023.

In his Statement of Claim, he insists he is entitled to N28.5 million in salaries and allowances for the remaining 15 months of his tenure. Additionally, he seeks an official SUV or its monetary equivalent of N130.7 million, along with N30 million for legal costs, special, and general damages.

BIPC Hits Back with Counter Claim

In response, BIPC, represented by counsel Nathans Gwebe Esq, has not only opposed Dr. Adum’s claims but has also counter-sued him for N104.6 million in alleged misappropriations and damages.

BIPC’s Counter Claim states that its Board of Directors approved the purchase of official vehicles for top management, including Dr. Adum. Acting on this approval, he allegedly authorized the withdrawal of N142.4 million from the company’s account on April 17, 2023. Out of this amount, he reportedly collected N65.8 million as the market value of his official vehicle.

Further, BIPC alleges that Dr. Adum received N13.7 million for an international workshop in the United States but failed to attend and has refused to refund the amount. Additionally, the company claims he unlawfully took a Toyota Hilux van (MKD 47 MT) valued at N35 million without board or management approval, violating company policy.

BIPC also disputes the former MD’s salary claims, detailing his official pay structure as follows:

The company argues that payroll entitlements must be earned and that Dr. Adum has no valid claim to the disputed amounts.

Legal Battle Continues

With both sides digging in, the case is set for hearing on May 27, 2025, before Hon. Justice Isele. As the courtroom drama unfolds, all eyes will be on the legal arguments and evidence presented, which could have significant implications for corporate governance and public sector accountability in Benue State.
